Preamble

This document defines the terms of use for the Colecia service, a collective artificial intelligence infrastructure based on self-organization mechanisms (stigmergy) and metacognition.

By accessing the service, the User acknowledges having read, understood and accepted these Terms of Service in their entirety. These terms comply with the provisions of the European Artificial Intelligence Regulation (AI Act) applicable as of this date.

Article 1 – Purpose and nature of the service

1.1. Service definition

Colecia is an automated assistance tool enabling document analysis and synthesis generation through the dynamic coordination of specialized agents. The service relies on a complex technical architecture using external language models (LLM) and intelligent routing algorithms.

1.2. Best-efforts obligation

The service is provided under a best-efforts technical obligation. ColeciaSoft undertakes to implement all reasonable means to ensure the proper functioning of the service.

The service does not in any case constitute:

The User acknowledges that outputs produced by Colecia are aids to reflection subject to technical uncertainties (hallucinations, errors). The User retains full responsibility for decisions made based on this content and undertakes to verify critical information.

Article 2 – AI Act compliance

2.1. System classification

In accordance with the European Artificial Intelligence Regulation, Colecia is classified as a low-risk AI system, subject to strict compliance with the terms of use defined below.

It is strictly prohibited to use Colecia for the following purposes:

Any violator may face immediate suspension of access without notice or refund, and potential reporting to competent authorities.

2.3. Significant human oversight (Human-in-the-loop)

For any analysis potentially impacting individuals or sensitive business processes, the User undertakes to perform explicit validation through the dedicated interface. This action is logged and retained as proof of compliance with the human oversight obligation.

The user is expressly informed that they are interacting with an artificial intelligence system. This notice is displayed:

Article 3 – Intellectual property

3.1. Architecture protection

The entire technical architecture of Colecia constitutes a trade secret protected by intellectual property law. This includes:

3.2. Reverse engineering prohibition

Any attempt at disassembly, decompilation, model extraction or reproduction by imitation is strictly prohibited and constitutes an act of counterfeiting.

3.3. Output usage license

ColeciaSoft grants the user a non-exclusive, non-transferable, worldwide and perpetual license to use content generated by the service.

This license is limited to:

Direct resale of outputs as a standalone product is prohibited without prior written consent.

The User warrants that they hold all necessary rights to the input data provided and retains full ownership thereof.

Article 4 – Traceability and data

4.1. Immutable logging

In compliance with the traceability requirements of the European Artificial Intelligence Regulation, Colecia implements an automatic, tamper-proof logging system (WORM — Write Once, Read Many).

The user has access, through the interface, to an "Export Audit" button that generates a digitally signed PDF report (qualified signature, RFC 3161). This document constitutes valid electronic evidence in case of dispute or regulatory inspection.

ColeciaSoft also maintains complete technical documentation available to competent authorities upon request.

4.4. Input data and non-training

Data submitted by the User is processed exclusively for the purpose of providing the service in real time.

No input data or generated output is used for training, fine-tuning or improving models.

Data is deleted at the end of the session, except for audit logs defined in Article 4.1.

Article 5 – Security and liability limitation

5.1. "Fail-closed" security principle

The Colecia system is designed according to the maximum security principle. In case of anomaly (insufficient credits, technical error, intrusion attempt):

ColeciaSoft's liability is strictly limited to direct, material and proven damages resulting from total service unavailability.

Total compensation shall not exceed amounts paid by the User during the three (3) months preceding the occurrence of the damage.

Article 6 – Pricing, credits and billing

6.1. Credit model

Access to the service is subject to a prepaid model. Each request consumes credits according to its complexity.

6.2. Payment

Payment is made upfront by credit card or bank transfer. Any unpaid amount results in automatic access suspension.

6.3. Validity

Credits are valid for 12 months from purchase. After this period, they expire without right to refund. The User is notified by email when their balance falls below 20%.

6.4. Downtime

In case of total technical unavailability exceeding 4 consecutive hours, ColeciaSoft may grant compensation credits at its discretion.

6.5. Refund

Purchased credits are non-refundable.

Non-essential trackers are only placed after the User's prior consent, collected via a banner compliant with CNIL recommendations. The User may withdraw consent at any time via the cookie manager.

These Terms of Service take effect on February 28, 2026 for an indefinite period.

In case of force majeure, ColeciaSoft is released from all liability. The User shall not be entitled to any compensation, except as provided in Article 6.4.

Article 11 – Modification of Terms

ColeciaSoft reserves the right to modify these Terms to adapt the service to technical, legal or economic changes.

Any substantial modification will be notified by email at least 15 calendar days before its effective date. Continued use of the service after the effective date constitutes acceptance of the new terms.

These partners are selected based on security and GDPR compliance criteria. Compliant contracts govern each subcontracting relationship.

ColeciaSoft shall not be held liable for damages resulting from a subcontractor's own fault, provided that said subcontractor was chosen with all due diligence.

Article 13 – Non-assignment and trademark protection

13.1. Prohibition of assignment

The User may not assign their rights or obligations (account transfer, credit resale, sub-license) without ColeciaSoft's prior written consent. Any unauthorized assignment is null and void.

13.2. Trademark protection

The names "Colecia" and "ColeciaSoft", the logo and the domain name are exclusive properties of ColeciaSoft. Any unauthorized use is prohibited.

Article 14 – Applicable law and jurisdiction

These Terms of Service are governed by French law.

Article 15 – Entirety and severability

These Terms of Service constitute the entire agreement between the parties. In case of conflict with a previous version, this version shall prevail.

If one or more provisions are deemed null or unenforceable, they shall be deemed unwritten and the remaining provisions shall remain in force.
